TERMS & CONDITIONS OF MEMBERSHIP at MOOD REFORMER PILATES LTD

Each member and prospective member is asked to carefully read these terms and conditions which should be observed in the interests of maintaining the highest quality of Mood Reformer Pilates Ltd and of its facilities.

By accessing our website, booking or attending a class, you agree to be bound by these Terms & Conditions and all documents expressly referred to in them.

1. Definitions

“Mood Reformer” means Mood Reformer Pilates Ltd, including its directors, employees, instructors, contractors, and agents.

“Member/Membership” means anyone who is making a monthly payment or has an active class pack with Mood Reformer

“Members” means all clients of Mood Reformer

“Session” means the credit tokens used to book classes.

“Membership Agreement” means the House Rules, these Terms and Conditions

“Membership Term” means the period of time from the commencement date of agreement to membership to the last day of membership as determined by the membership cancellation terms

“Personal Services” means any services that are delivered on a private basis to include but not exclusively activities such as 1:1 classes, private group classes or physiotherapy treatments.

2. Purchases, Bookings Policy and Membership

2.1 The purchase of any membership shall constitute a legally binding contract between Mood Reformer and the Member upon the terms and conditions of this agreement.

2.3 All bookings, changes, and cancellations need to be completed online via our booking system, Gymdesk

2.4 Payment is required at the time of booking. All Memberships are non-transferable and non-refundable.

2.5 Welcome offers are available only once per new client. Mood Reformer reserve the right, at its sole discretion and at any time, to terminate or suspend the Membership of any Member with duplicate accounts.

2.6 All fees are non-refundable.

2.7 Mood Reformer classes are graded and require members to demonstrate a specific level of skill before attending certain sessions. Skill assessments will be conducted individually by Mood Reformer staff, who retain full discretion in determining whether a member meets the necessary criteria for participation in a particular class type.

2.8 Members are solely responsible for booking only those classes for which they are eligible. Mood Reformer bears no responsibility for credits lost as a result of ineligible bookings. Should a member attend a class without meeting the eligibility requirements, the booking will be cancelled and the credit forfeited; refunds will not be provided.

2.9 Instructors and classes may change. Mood Reformer management will make every effort to provide notice as early as possible when changes occur, but cannot guarantee notification within a specific timeframe.

2.10 A minimum of three participants is required for each class to proceed. Classes with three or fewer bookings 24 hours prior to the scheduled start time may be subject to cancellation. In such cases, Mood Reformer will issue a credit to members' accounts for the affected class. Refunds will not be provided.

2.11 Members must upload a passport-style photo before their first class. Mood Reformer may deny entry or suspend booking privileges if a suitable photo is not provided. No refunds or credits will be issued if a member is turned away for this or any other reason.

3. Cancellation And No-Show Policy 

3.1 12 Hour Cancellation Policy

You may cancel a booked Session without charge up to 12 hours before scheduled class start time via the Gymdesk Website or App.

3.2 Late Cancellation (under 12 hours)

The Session will be deducted from your Membership. No refund or credit will be issued. You will be classed as a ‘No-Show’.

3.3 No-Shows

If a member is classed as a ‘No-Show’ for 3 Classes in any 4 week period, they will be charged £5 for each additional absence for a period of three months. 

This fee reflects administrative and instructor costs. 

4. Waitlist Procedure

Clients can add themselves to a waitlist for a full class. If someone cancels before the 12 hours, you will be automatically added to the class and notified via email. If you are added to the class from the waitlist and do not cancel within the cancellation period, you will be responsible for payment of each class you are added to.

5. Age Restrictions

Mood Reformer requires clients to be a minimum of 16 years of age to participate. Clients between the ages of 16-18 may only participate in classes with written parental or legal guardian consent form and Liability Waiver completed prior to attendance. No one under 16 is allowed to attend classes.

6. Class Packs

6.1 Class Packs are valid for the period stated at the time of purchase, starting from the purchase date. 

6.2 Unused Sessions expire at the end of the validity period and are non-refundable.

6.3 Class Packs are non-transferable and may only be used by the purchasing Member.

6.4 Members holding Class Packs may extend their pack expiry date by one month for a fee of £5. Extensions are available for purchase through the app or by email, and members are required to notify administration by email so that the extension can be applied.

7. Subscription Memberships

7.1 Upon enrolment of a Subscription Membership, Members are required to pay for an entire month irrespective of their registration date. Subsequent payments will be processed on the 1st day of each month until the membership term concludes or either party terminates the agreement. 

7.2 Subscription memberships have a minimum 3 month contract period after which time the membership may be cancelled by the member by giving 14 days notice to Mood Reformer in writing via the app or emailing marple@moodreformer.co.uk

7.3 Subscription memberships have a 10 day Cooling Off period, you may cancel your subscription at any time up to 10 days after you signed up. Any Sessions used prior to cancellation will be charged at the current Single Class rate.

7.4 Subscription memberships cannot be frozen or suspended. 

7.5 Unused Sessions roll over for members to use any time before membership cancellation. Sessions cannot be used after the membership ends.

7.6 All subscription members automatically receive an Extra Class (Subscription Membership) pack for discounted pricing on extra classes. Members are responsible for booking classes with the correct membership type. Refunds are not provided if classes are booked using the wrong membership.

7.7 All membership payments shall be made automatically via a Credit or Debit Card or Bank Transfer of the members’ choice. 

7.8 No payments above your agreement will be taken. Arrears will be collected using your existing payment method. If arrears remain after 30 days, legal action will follow to recover the arrears, along with a £100 administrative fee and any notice period costs.

8. Pricing 

Mood Reformer reserves the right to increase the price of membership payments. All prices are subject to an annual increase and notice will be given to members in writing by email and/or in the app to the member at least 28 days prior to the price increase.

9. House Rules 

9.1 Mood Reformer retains the authority to terminate any service without notice should a Member violate any of these terms and conditions.

9.2 Members are advised that any personal belongings brought into Mood Reformer facilities are done so at their own risk. Mood Reformer accepts no responsibility for any liability, claims, or expenses resulting from the loss, theft, or damage of personal belongings or property within its premises.

9.3 There shall be no smoking on any part of Mood Reformer premises.

9.4 All Members are required to treat other Members and Mood Reformer staff with respect while on Mood Reformer premises.

9.5 Members must always follow the instructions and advice given by Mood Reformer’s management and staff to ensure safe and hygienic use of the facilities.

9.7 Mood Reformer may, at its sole discretion, deny a Member access if it believes using its facilities could pose a risk to the individual's health.

9.8 Members are required to follow the instructions of the instructor at all times.

9.10 In the interests of safety and hygiene, no crockery, glass or food are permitted in the changing rooms or studio. Only water is permitted in the Studio. Only sealed drink bottles are allowed on the studio floor, no open cups. With the exception of guide dogs, no pets are permitted in Mood Reformer facilities.

9.11 Members must use the main entrance(s) to the Studio when entering or leaving the Studio. Fire exits are there in the interests of safety and Members must not interfere with these exits for any reason. In the event of a fire, Members are asked to make their way to the nearest available exit.

9.12 To ensure the comfort of other members and our staff, as well as your own safety, staff at Mood Reformer may refuse entry to any class or service if you arrive more than three minutes after the scheduled start time. In this case, any credit used to book the class will be forfeited and no refund will be issued.

10. Appropriate Attire

10.1 Appropriate attire must be worn in the studios. In the event that a Member shall observe a want of repair or any situation which could give rise to personal injury, the Member should notify a member of staff as soon as possible.

10.2 Grip socks are mandatory. No shoes are allowed on the equipment. No bare feet or toes. Towels are recommended, particularly during warmer weather.

11. Photography and Marketing 

11.1 We may occasionally take photographs or videos for marketing purposes. 

Please inform us in writing (by emailing marple@moodreformer.co.uk) if you do not consent to appearing in any promotional material.

11.2 For the comfort and respect of all clients, filming or the use of tripods during class is not permitted. However, clients are welcome to remain in the studio for up to 10 minutes after their session to film or take photographs. Clients must request permission before recording and instructors may choose whether they are comfortable being filmed.

12. General

12.1 Mood Reformer may change these terms and conditions from time to time. By visiting a Mood Reformer facility you are accepting that you are bound by the current terms and conditions. Any changes to terms and conditions will be notified to you. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.

12.2 Members are required to update and maintain up to date contact details for themselves and it will be assumed that all correspondence sent to members has been received.

12.3 C.C.T.V. cameras will be used in various parts of the Studio Premises, purely for surveillance, health and safety purposes.

12.4. Details of class types and times at Mood Reformer may vary from time to time and will be updated and maintained on our online booking system.

12.5 Any marketing, educational or other materials of any nature whatsoever produced by the Mood Reformer which are made available to Members will at all times remain the property of Mood Reformer. 

13. Communication

13.1 By providing an email address and phone number to Mood Reformer, the Member consents to receiving email and/or text communications from the Company, including notices pursuant to the Terms and Conditions. The Member also accepts the risk that email may not be a secure and confidential means of communication. The Mood Reformer will not be liable for any loss or damage suffered as a result of communicating with a Member by email and/or text message.

13.2 Members can opt out of receiving emails, texts, or App messages from Mood Reformer at any time. By doing so, they understand and accept that Mood Reformer may be unable to notify them about class changes, price increases, or other updates. Mood Reformer is not liable for any loss or damage resulting from a Member's choice to unsubscribe from communications.

14. Warranties

Mood Reformer warrants that the Products and Services will be supplied with reasonable skill and care.

15. Limitation of Liability Statement

15.1 To the fullest extent permitted by law, Mood Reformer, its directors, employees, contractors and instructors shall not be liable for any injury, loss, or damage arising from:

  • Participation in any classes or activities.

  • Use of the studio facilities or equipment.

  • Reliance on information provided on our website or booking platforms.

15.2 This limitation of liability clause must be read together with our liability waiver which forms an integral part of the contractual agreement between the client and Mood Reformer, and which sets out further details relating to assumption of risk, acknowledgments and exclusions of liability. Personal belongings are brought into the studio at the risks of clients.

16. Privacy Policy 

Usage of your personal information is governed by Mood Reformer’s privacy policy, which forms part of these Terms and Conditions. 

Mood Reformer agrees to comply with its obligations under the Data Protection Act 1998 or any other relevant privacy or data protection laws.

17. Force Majeure 

Mood Reformer shall not be held liable for any failure to perform its obligations due to events outside its reasonable control, including but not limited to acts of God, natural disasters, government restrictions, or strikes.

18. Governing Law

18.1 This Agreement shall be governed and construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

18.2 If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

All members and applicants are requested to thoroughly review these terms and conditions, which have been established to uphold the exceptional standards of Mood Reformer and its facilities.

LIABILITY WAIVER

By booking or attending Mood Reformer Pilates Ltd Classes, I, acknowledge participation is at my own risk. I confirm I am in good health and capable of exercise; if my health changes or I become pregnant, I will inform Mood Reformer Pilates Ltd and avoid exercises my doctor advises against.

I am responsible for assessing my fitness levels and consulting a healthcare professional if I am unsure about my ability to participate. 

To the maximum extent permitted under English and Welsh law, Mood Reformer Pilates Ltd shall not be liable for

  • any injury or harm resulting from participation in the Classes or attending the studio;

  • loss, theft, or damage to personal property arising from participation in the Classes or attending the studio; and

  • any indirect, incidental, or consequential loss or damage.

By participating in Mood Reformer Pilates Ltd Classes, I acknowledge and accept the inherent risks associated with physical exercise, including but not limited to injuries, strains, or accidents, and I waive the right to pursue legal action against Mood Reformer Pilates Ltd for any such occurrences.

I agree to indemnify and hold harmless Mood Reformer Pilates Ltd from any claims, liabilities, damages, or expenses arising from my participation in Classes.

This Waiver does not exclude or limit liability for death or personal injury caused by negligence or any other liability that cannot be excluded under English and Welsh law.
